Ask a Lawyer: Legal Insights for Land Access

Overview

Why do farmers need to understand the law? Why is a legal contract essential in land matching? What should you know about lease agreements, and how should you prepare for negotiations?

These questions and more will be answered in a series of three informative webinars, each 60 minutes long. You will gain a solid understanding of the legal aspects of leasing land and living on leased land. The webinars will cover essential tips for navigating lease negotiations and creating legal agreements, and provide an overview of local regulations and agreement frameworks.

In the first webinar, you will explore the importance of having a legal contract in land matching, how to prepare for negotiations, and what to consider during lease discussions. The second webinar will delve deeper into these topics, featuring questions and examples from attendees and real-world situations. The final webinar will focus on various types of land lease agreements, local regulations—including ALR residential flexibility—and different agreement frameworks. The panelists will also share their top tips for legal agreements.

The webinars feature Priyan Samarakoone, lawyer at EQ Law who provides legal support for the B.C. Land Matching Program; Andrew Adams, Land Matcher – Central & Northern B.C.; and Darcy Smith, YA’s National Director (previously B.C. Land Matching Program Manager).

This information is applicable to current and aspiring farmers, as well as landholders, working towards land leasing. Farmers seeking land and landholders wanting to lease their land will also find value in the considerations and resources mentioned. While this content was developed through the B.C. Land Matching Program (BCLMP) and focuses on B.C.-based regulations and case stories, the topics covered are relevant to anyone considering land sharing.
